Much lip service has been given to stalking legislation by the government since Amy Boyer's murder, but the fact of the matter is that better law is coming out of the states than Congress. Docusearch reached a settlement with the Estate of Amy Boyer approximately one year after the New Hampshire Supreme Court ruling.

Unfortunately for William Berkeyheiser, A-Plus Investigations, Inc. failed to heed the warning from New Hampshire that reverberated throughout the freewheeling Internet data broker's market in the aftermath of the Supreme Court decision. Although several investigators declined Stanford Douglas Jr.'s business, A-Plus aka SpiesOnline.com chose to provide the sociopath with personal information, including the names and addresses of Berkeyheiser's grown daughters and the fact that Berkeyheiser did not own a gun.

Douglas, of Northeast Philadelphia was sentenced to life in prison for the March 2005 shooting death of Berkeheiser over a perceived racial slur seven years earlier. The victim's widow has filed a wrongful death lawsuit against A-Plus as well as the assassin.

If people are lax about security of data they collect or use about you, it's time for them to recognize they can be held accountable. These information brokers have aided the work of thieves, harassers, and stalkers, in addition to detectives and investigators. Judge Robert H. Alsdorf, Washington, wrote in a memorandum ruling, "It is hard to conceive of a broader invasion of privacy than freely disseminating the information to the entire world and rendering it instantaneously accessible to all."

In 1960, eminent legal scholar William L. Prosser documented how privacy as a legal concept had come to constitute four distinct torts. That is, a person whose privacy has been invaded could sue the privacy invader for damages. These torts still exist today:

1. Intrusion upon seclusion or solitude, or into private affairs;
2. Public disclosure of embarrassing private facts;
3. Publicity which places a person in a false light in the public eye; and
4. Appropriation of name or likeness.

There's no shortage of volunteers willing to assist Loretta Serrano in her never ending pursuit of personal information about individuals that question and criticize her disturbing online behavior.

Loretta’s passion for dispensing private data about family members of her targets is not only sinister but also indicative of her ineptitude in resolving conflict on a one-to-one basis. It’s a spineless creature who identifies an opponent’s relative and indiscriminately broadcasts the unwitting victim’s personal details on the WWW in retaliation of a perceived slight.

Collateral damage inflicted on people that had no interaction with the invertebrate, who were not the source of her displaced animosity, and in all probability are not aware of her undistinguished existence. Mrs. Serrano is not a sympathetic figure and those that aid and abet her by invading another's privacy, then distributing and publishing the personal information, are equally reprehensible.

Notice how Misfit Margaret was willing to finance a private data transaction, but balked at the idea of disclosing her own address for verification in the process. Imagine that?

I checke [sic] the number on one of those search sites and it does go back to Toronto ON. I was prepared to pay the $14.95 for more but they wanted my billing address for the credit card and that seemed like too much information to give. If that's how it's done, I'll do it. "I don't follow all of this ruckus too closely, but I have a couple of ideas about legal action. First, I think you should explore any state laws regarding tortious interference with a business contract w/r/t her attempting to cause problems for you in the workplace. Second, I would call the local Feds and see if they have any interest. There is diversity of citizenship and I know there are a bunch of fed attys now assigned to internet stuff and they don't have enough to do. Not sure about jurisdiction over Canadian national, though. DISCLAIMER - this is not the sort of law I practice.
